Use of pork to derail impeach bid
denounced
SENATE minority leader Aquilino Pimentel Jr. yesterday denounced Malacañang’s promise of early release of their pork barrel if they refuse to sign the new impeachment complaint against President Arroyo.
"I can only hope that the congressmen and women concerned do not allow Gloria to buy them off as some of them had turned around after she unleashed her financial clout over them," he said.
Pimentel said the impeachment case last year failed to get the required number of votes because some congressmen succumbed to Arroyo’s offer of quick release of their Priority Development Assistance Fund, not to mention additional funding allocations.
"Unfortunately, some members of Congress cannot rise above partisan and monetary considerations even in the discharge of their duties," he said.
Pimentel expressed hope that lawmakers will decide on the merits of the impeachment complaint and on the dictates of their conscience.
"I hope that there would be more, not less, who would stand up for what is right regardless of the consequences," he said.
Opposition lawmakers earlier complained that the Department of Budget and Management withheld their pork barrel for supporting the impeachment complaint against President Arroyo.
They said that Malacañang, on the other hand, allegedly released "bonuses" to lawmakers who successfully blocked the impeachment bid.
Presidential chief-of-staff Michael Defensor has warned administration congressmen that they should not expect Malacañang to help them in their reelection next year if they signed the new impeachment resolution.
Opposition lawmakers have to muster 78 signatures to transmit the impeachment complaint directly to the Senate.
The original number was 79, but the House has lost two members with the appointment of Ronnie Puno as interior secretary and Rolando Andaya Jr. as budget secretary.
The other day, the Palace announced the appointment of Rep. Jesli Lapus as education secretary. He will assume office at the end of the month.
Yesterday, 48 public school teachers led by the Alliance of Concerned Teachers and peasant groups led by the Kilusang Magbubukid ng Pilipinas (KMP) and Pamalakaya affixed their signatures on the fifth installment of the impeachment complaint which will be filed on July 24, the day President Arroyo delivers her state of the nation address.
Arroyo said only the Almighty can judge whether she has been good or bad.
Arroyo made the statement in an interview with a radio station in Pampanga.
Arroyo reiterated her statement on her first day in office that she does not want to be known as a "great president" but a "good president."
She said in the end God, and not history, will be the one to judge what she has done.
"What were we born to be? We were born to serve God. In the end it’s going to be God who will judge who has been good and who has not been good. That’s for the Lord to determine for the rest of my life," she said.
Two bishops said clean and peaceful elections and not another people power are needed to push socio-political reforms.
"Madami na tayong people power pero hindi naman nababago ang sistema," said Bishop Pedro Arrigo.
Arrigo, chair of the Episcopal Commission of Prison and Pastoral Care, said the country needs "a new breed of leaders who will push changes."
Arrigo said impeachment will again be discussed at the Plenary Council in September "if the need arises."
Bishop Antonio Ledesma of Ipil, Zamboanga, said the impeachment process is still a good way of searching for the truth behind allegations against the President. He said that while no alternative is available, the impeachment process must "continue as of now.":mad:

Gloria Arroyo's JUSTICE Secretary Raul Gonzalez yesterday said five party-list congressmen who had sought protective custody from the House of Representatives are not off the hook yet despite a Makati court’s rejection of an amended complaint charging them with rebellion.
As the so-called Batasan 5 finally left the House premises after more than two months of being under its protective custody, Gonzalez said: "I hope that they will go back to the mountains. That’s where they belong."
Gonzalez said the refusal of Makati Judge Jenny Lind Delorino to accept the amended information on the case was a mere technicality, and should not be taken to mean acquittal for the five congressmen linked with the Left.
Gonzalez maintained the court has yet to assume jurisdiction over the case as Rep. Satur Ocampo, Ted Casiño, Joel Virador, Liza Maza and Rafael Mariano have yet to be arraigned. The five were accused of involvement in a plot to topple the Arroyo administration.
"They can only be off the hook if they were acquitted, then you can’t revive it because that will be double jeopardy," he said.
"They can run but they can’t hide. The law will take its course under due process. I assure them that we do not manufacture evidence as they have been claiming," he added.
[CENTER]Gonzalez said government "did not blink" when it backtracked on its initial position that the five should be arrested.
"We just simply recognized the technicality that indeed, even if we do not agree with it, there was that court order. There was a technicality that there was no information against them in court kasi di tinanggap ’yung charge. So there is no charge in court against these people. The judge said that they are free to go unless they are charged with some other offense. We could have invoked and insisted to prove our manhood," he said.
After Delorino’s junking of the justice department’s amended information on Thursday last week, Gonzalez said the five could still be arrested. On Sunday, he said arresting the five would only give them the opportunity to use it for more media mileage.
With the filing of a motion for Delorino’s inhibition, the DOJ said prosecutors do not have to insist on the amended information indicting 47 respondents in the rebellion case, including the Batasan 5.
"We can just file a new one and ask for a consolidation. We can file a new information, not a new case, a new information and ask that it be consolidated with the case that was first filed," he said.
The original complaint was filed against Anakpawis Rep. Crispin Beltran and 1Lt. Lawrence San Juan, a leader of the Magdalo group that staged the Oakwood mutiny in July 2003.
Gonzalez said that once a court accepts the new information and finds probable cause, the party-list congressmen can no longer claim they were denied due process during preliminary investigation.
He also said the decision of Speaker Jose de Venecia to take custody of the five congressmen put a strain between Congress and Malacañang and him.
Solicitor General Antonio Eduardo Nachura said government is studying the possible filing of new rebellion charges against the Batasan 5 based on new actions.
"There are other possible charges, possibly rebellion," he said.
He said it is the justice department which is in charge of such studies.
Gabriel Claudio, presidential political adviser, said Gonzalez’ decision to let the Batasan 5 walk out of the House without being arrested averted a physical confrontation and an undeserved political drama with the Batasan 5 as heroes and government as villain.
"It is clear that the decision to let the Batasan 5 walk away is without prejudice to whatever reinforced legal action government may take against the Batasan 5 in the light of last week’s decision of the Makati RTC," Claudio said.
He said the five are free to file charges against the justice department, adding the DOJ and other government authorities can adequately defend themselves against the charges.
But he was quick to add: "It is inappropriate for such charges to be filed given the circumspection and prudence DOJ exercised in not ordering the arrest of the Batasan 5 when they left the House premises."
The PNP said based on the DOJ’s analysis of the case, the Batasan 5 can still be arrested because the rebellion case filed against them has not been totally junked by the Makati court.
"Dahil ang desisyon ng Makati RTC, hindi naman nito dini-dispose yung kaso, meaning it has not ruled on the merits of the case. Yung nangyari doon ay technicality, hindi tinanggap yung amended information," said Senior Supt. Samuel Pagdilao, PNP spokesman. (The decision of the Makati Regional Trial Court (magistrate) does not categorically disposes the case, meaning it has not ruled on the merits of the case. What happen there (in the court) is a mere technicality, it does not accept the amended information.))
Pagdilao said PNP would not submit any additional evidence against the Batasan 5. It is up to the justice department to decide on that, he said.
Pagdilao also said the PNP will not monitor the movements of the Batasan 5.
He said the PNP will look into their actions only once they pose threats to national security.
"Not really in the sense that our eyes are fixated on these gentlemen and one lady. But suffice it to say that the PNP is on the lookout for any activity that would endanger the national security and peace of our community," Pagdilao said.

Mrs. Arroyo unconstitutionally grabbed power from a duly elected sitting president Joseph Estrada in 2001 and again cheated her way to the presidency by vote rigging and massive election fraud during in 2004 Philippine Presidential Election.
Her administration is a mess. Widespread corruption, scams after scams, deceptions, briberies, organized serial killings of activist students, workers, farmers, journalist, lawyers and local politicians to silence the opposition against her illegitimate administration.

Boogle, thanks . Keep us informed. There is world wide terror and corruption in all countries and it looks like the Philippines is in a mess too. I knew there was some disturbances there but no news ever reaches us in Australia. Not even a whisper. We have enough problems with our evil Prime Minister who is a warmonger and a lunatic.
Getting back to the Philippines I heard that the USA Naval and Military bases there left a lot of toxic pollutants there which the USA is taking no responsibility for. I doubt that Mrs. Arroyo would help to clean up the mess because it seems she is too busy stirring up terrorism in your country.
I did not realize the situation there was as bad as what you make it out to be , but I believe you.
Can you tell me more about the killings of activist students, workers, farmers, journalist, lawyers and local politicians to silence the opposition against her illegitimate administration?

It's true Bart that US military bases left here an unaccounted amount of toxic pollutants at Clark Air Base Pampanga and Subic Naval Base Zambales both in Luzon. There is news of an alarming cases of cancer resurgence among the locals there.(I mean resurgence because there is a loose government news blackout policy).

The Filipinos are just waiting the May, 2007 local election to remove those members of parliament that were bribed by Gloria into dismissing the impeachment complaints against her.

Broadcaster shot dead in southern Philippines
A broadcaster was shot dead Tuesday by unknown assailants in the southern city of Digos, a regional police official said.
Armando “Racman" Pace of Radyo Ukay Digos was shot by two motorcycle-riding men at the vicinity of Rizal Avenue about 1 p.m., said Chief Supt. Ricardo Quinto, police chief for Region 12.
At the time of the incident, Pace, 51, was on his way home, Quinto said. The victim was also on board his motorcycle when attacked.
Already, police has formed task force “Pace" to go after the suspects and determine the motive for the killing.
Statistics from the National Union of Journalists of the Philippines (NUJP) showed that Pace was the 82nd journalist slain since democracy was regained in 1986.
He was the 9th victim this year, the NUJP said.:(
The spate of journalist killings has prompted international media watchdogs to describe the Philippines as the most dangerous country for working journalists second to Iraq.

A senior member of the Catholic Church hierarchy said Tuesday the Catholic Bishops Conference of the Philippines (CBCP) owes its flock an apology for the controversy generated by the congregation’s “confusing" statement on the impeachment complaint against President Gloria Macapagal Arroyo.
Bishop Teodoro Bacani Jr said the "unsavory happening" where Malacañang quickly put a spin on the statement in its favor teaches bishops to be simple and direct in their statements.
"I do think we bishops can make a 'mea culpa' for the lack of clarity in the statement, and for the underlying causes of that lack of clarity. It was a lack of clarity that could have been avoided," Bacani said in his column in the Manila Standard Today newspaper.
"I hope that we bishops take this unsavory happening as a teachable moment. The Lord is teaching us through these events and their unhappy consequences. We cannot afford to make more mistakes of this kind," he added.
Bacani said the biggest lesson is that bishops should be "simple and direct in their statements, and phrase them in such a way that they cannot be used by vested interests."
Bacani, who celebrated a mass for a truthful impeachment process against President Arroyo in Manila on Sunday, said the CBCP statement had left many people disillusioned.
Even if the statement had meant to cleanse the election process and prevent this year's impeachment process from meeting a similar fate as last year, Bacani said it was lacking in clarity.
The outspoken prelate said the addition of the line, "in the light of previous circumstances, we are not inclined at the present moment to favor the impeachment process as the means for establishing the truth" compromised the statement.
He said this was the part that Malacañang fully exploited, with government-run stations announcing "Bishops say no to impeachment" almost immediately after the press conference.
Yet, Bacani said the bishops never changed their stand in seeking the truth and not rejecting the impeachment process as a way to seek the truth.
"It is unfortunate that the bishops did not fully recognize the clouding effect of this added statement. If they had more time in their hands, they perhaps could have further reflected on the possible impact of their words," he said.
Bacani is the spiritual director of the Catholic charismatic group, El Shaddai.
During the short-lived Estrada administration, El Shaddai leader Mike Velarde acted as one of former President Joseph Estrada’s spiritual advisers.

The sad truth is that everyone needs help and seeing that the Philippines are having their elections in May 2007 , should give you an added incentive to prepare for honest elections in May.
It's pretty hard to help the philipino people to achieve honest elections in May because every other country is in the same situation as the Philipiinies. They are all dealing with similar corruption. Just look at the USA !
Last time the Philippines was in a mess with Marcos , Australia did a lot to help get rid of Marcos, but now Australia is in no position to help anyone. Australians can't even help themselves. John Howard has caused many problems in Australia and overseas with his warmongering policies, and the Australian people can't even help themselves now , yet alone help the philipino peolple.

The militant group Kilusang Magbubukid ng Pilipinas (KMP) yesterday lambasted Philippine National Police (PNP) chief Oscar Calderon for not fulfilling his promise to stop the unabated political killing of militants and journalists since his assumption as PNP chief last July 5, 2006.
By all indications Calderon is eating his words. Since July 5,2006, not one of the previous cases of the 705 activists killed was solved let alone a suspect was arrested. What is worse is more than nine activists have been killed since then,” KMP secretary general Danilo Ramos said in a statement.
He added instead of putting a stop to the killings, they have only become aggravated, with assassins even having the impunity of not even covering their faces anymore because they know that they would not be arrested.
It's like Afghan, Iraq or Cambodia is happening here in the Philippines.

Unless it improves its human rights record, the Philippines risks sanctions from developed countries that are now more concerned about human rights records of countries they invest in.
Commission on Human Rights (CHR) chairman Purificacion Quisumbing yesterday said developed countries are not likely to invest in or aid those on the United Nations (UN) blacklist.
“The developed countries now look at the human rights records of each country they intend to offer assistance or cooperation. That’s one of their criteria,” Quisumbing said during an interview over radio station dzBB.
She said the Philippine government stands to lose face in the international community if it is blacklisted because it is a member of the newly formed UN Human Rights Council.
Quisumbing added the Philippines, as a member of the new UN council, is a front-liner in the field of human rights.

Bart I guess the Los Angeles immigration judge was being taken for a ride by Jocelyn "Joc joc" Bolante's handler thru his lawyer Schmidt by moving to close the hearing to the media and the public. Are they're trying to conceal something anomalously bigger than what was known publicly that might come out into open during the hearing . :rolleyes:
Bolante attends immigration hearing in LA
Ex-agriculture undersecretary Jocelyn "Joc-Joc" Bolante faced a Los Angeles immigration judge on Monday for the first hearing on the removal proceedings against him, ABS-CBN North America News Bureau reported.
Bureau chief Ging Reyes said Bolante, sporting a navy blue jumpsuit used by level 1 detainees, attended the hearing despite the absence of Bolante's lawyer, Christian Schmidt.
Schmidt, who was in Chicago, spoke to the judge through speaker phone.
Schmidt filed a motion for continuance to give his group more time to prepare for the case. He also moved to close the hearing to the public, saying his client has been the subject of false and biased reporting.
Smith further argued that the presence of the media in the courtroom will harm Bolante’s interest and good name.
The judge, who granted the motion, asked the media as well as a representative from the Philippine consulate in Los Angeles, Edwin Caraos, to leave the courtroom. The media were only allowed in the hearing for about two minutes.
Reyes said Bolante, who had lost weight, talked frequently with his Filipino interpreter throughout the hearing.
Bolante's next court hearing is scheduled on August 24, Reyes said.
Reyes said the executive office for immigration review would neither confirm nor deny reports that Bolante is seeking political asylum in the United States. Experts and immigration lawyers, however, said that people who apply for political asylum normally seek a closed trial.
Virginia Kice, a spokeswoman for the US Immigration and Customs Enforcement office, said Bolante is detained without bail at the San Pedro Service Processing Center in Los Angeles.
Bolante was arrested on July 7 at the Los Angeles airport, where he flew in from Seoul, South Korea, owing to a canceled US business and tourist visa.
An ABS-CBN North America News Bureau report earlier said the US Embassy in Manila asked US immigration authorities to cancel Bolante's visa.
Bolante, accused of diverting P728 million in fertilizer funds to the campaign kitty of President Arroyo during the 2004 elections, was ordered arrested in December last year by the Senate for repeatedly ignoring subpoenas to attend its hearings.
Joc joc Bolante aside from being accused of diverting Peso 728 million agri fund to campaign kitty fund of then incumbent president and presidential candidate Gloria Arroyo (part of US Aid to the Philippines), he is also accused of being the bagman of First Gentleman Jose Miguel "Mike" Arroyo in his money laundering activities. Lawyers of two University of the Philippines students abducted in Hagonoy, Bulacan last June 24 have asked the Court of Appeals to cite for contempt ranking military officers who snubbed Tuesday’s hearing on their petition for habeas corpus.
Lawyer Rex Fernandez , lead counsel of the families of UP students Sherlyn Cadapan and Karen Empeño, said that the reason cited by Army Major General Jovito Palparan, Northern Luzon Command chief Maj. Gen. Romeo Tolentino, and a certain Lieutenant Samson – that they had to attend an anniversary celebration of the Army’s 7th Infantry Division based in Nueva Ecija – was “too cavalier".
“If we do not act on it, it will just escalate the violence. This will give impunity. We ask the court to stop it. The respondents must be cited for contempt," Fernandez said.

Filipino cleaner in London this young woman spoke four European languages as well as three of her own.I was incredulous that this was the best she could get.Marcos let the countries abroard treat his people so badly and pay them
dog shit wages that now it's endemic to their way of life.Such friendly warm
natured people to be treated like this is a tragedy,most have too send most

Western Ranger, you got it right. But not of what you know about Marcos. Marcos is much better than Gloria Arroyo. Arroyo is the worst of all. In less than 6 years 725 activist and militants were summarily executed by this fascist dictatorial regime. She institutionalized unemployment that's why Filipinos moved to work abroad. Gloria Arroyo masterfully rob our nation.
I believe Filipinos will regain its rightful place in this world in near due time just like Venezuela, Syria, Palestine, Iran, Jordan, Iraq, Cuba, North Korea, Laos, China, Russia, Turkey, Peru, India, Vietnam, Malaysia, Singapore, Cambodia, Thailand.

EU envoy slams activist’s slay, asks RP to solve other murders
The top envoy of the European Union (EU) to the Philippines has condemned the murder of an indi-genous leader last month and called on the govern-ment to solve political killings.
Ambassador Jan de Kok, head of delegation of the European Commis-sion (EC), yesterday asked Philippine authorities to ensure that perpetrators are brought to justice and be punished in accordance with the law.
In a statement, De Kok called on indigenous communities and advocates for the rights of the indigenous peoples to dedicate the International
Day of Indigenous Peoples to Alice Omengan- Claver, who was killed last July 31.
“Let us dedicate today to Alice and all those who paid with their lives defending human rights and fundamental freedoms not only of indigenous people but of all those whose rights and freedom need to be protected,” the EU envoy said in his speech during the launch of a cultural exhibition at Shangri-La Plaza in Mandaluyong City, Philippines held last Aug. 9 dedicated to the protection and promotion of the rights of indigenous peoples.

UN Body Set to Hear Rights Complaints vs Arroyo
Rights watchdogs led by Karapatan are set to file complaints and reports with the United Nations Human Rights Council in Geneva next month. The complaints over the spate of political killings will ask Macapagal-Arroyo to account for the killings which have to date claimed the lives of 729 persons.

PRESIDENT Arroyo is set to leave early this morning for a three-nation swing in Europe and then to Cuba and Hawaii.
Arroyo and her delegation will leave the NAIA Terminal 2 at 6:25 a.m. She will return on Sept. 18 at 1 p.m. at the Villamor Air Base.
Arroyo will go to Helsinki, Brussels, London, Havana, and Hawaii (http://www.malaya.com.ph/sep09/).

Former Arroyo Agriculture Undersecretary Jocelyn “Joc-Joc” Bolante and his principals may be in even hotter water, with Sen. Ramon Magsaysay Jr. now moving to put into action appropriate legal moves to effect the return to the country of Bolante, as well as bring the case up to his Senate counterpart in the United States Congress on the probable misuse of US funds for agricultural projects to Filipino farmers.
“The American taxpayers are also funding some social economic-agricultural projects here and they want to know how effective or ineffective is the use of thier funds here. So this is another venue,” he explained.

Full Circle: The Philippines and the Permanent Peoples’ Tribunal
After Afghanistan and the former Yugoslavia, the Philippines will only be the third country in history to be the subject of a session twice by the Permanent Peoples’ Tribunal (PPT). In 1980, the PPT convened a Session on the Philippines and found the Marcos dictatorship guilty of crimes against humanity after a trial. In March next year, the PPT will be hearing a case filed against President Gloria Macapagal-Arroyo, the U.S. government, and multi-national agencies “acting as their accomplices in violating the individual and collective rights of the Filipino people.”
The indictment places the highest priority on what the plaintiffs describe as the violations of civil and political rights.
The indictment, in summary, focuses on the following:
Violations of human rights, especially civil and political rights, with particular focus on summary executions, disappearances, massacres, torture as well as other vicious, brutal and systematic abuses and attacks on the basic democratic rights of the people.
Violations of human rights, especially economic, social and cultural rights of the Filipino people through the imposition of “free market” globalization to exploit them; transgression of their economic sovereignty and national patrimony; various forms of economic plunder and attacks on their economic rights; and the destruction of the environment.
Violations of the rights of the people to national self-determination and liberation through the imposition of the U.S. war of terror; U.S. military intervention; as well as the perpetration of crimes against humanity and war crimes; misrepresentations of the people's right to national liberation and self-determination as terrorism and the baseless “terrorist” listing of individuals, organizations and other entities by the U.S. and other governments.
