The irish republic police are threatining to take the police ombudsman office to the high court, in realtions to informations on the names of members of the public that complaint about them and the nature of that compliant because they believed that, such a complaint does undermined their prospect in the force.
But to be honest a police must search themself sometime and know that they themself does wrong to members of the public and if they can not get justice they turn to the ombudsman office for a redress on that virtue, they want a better prospect in their jobs but not for innocent members of the public, the law does not allowed the informations of the complainant to be revail under the act that established that office.
In fact power to determined who should be on bail and who should be reminded in custody must be remove from the hand of the garda siochana because of false imprisonment of innocent people, before an offence can be reminded we've got to look into the nature and the gravity which include the wording used in such an offence before any custody can be granted with due process of the law, every citizen must be protected with due process of the law not some ''Malice aforethoght'' with jeliousness that enconpasses some public order offences for example sometime.
Some garda believed that, since they're inn uniform anything goes anything they say or want goes, we're in the modern time not far past.
At the end of the day we must remembered that, presumption of innocent and burden of proofs does work together.
