I am unsure of what you mean by fallacy. Do you refer to the straight cucumber thing as a myth, or that it is ridiculous that such a thing was proposed and drafted?

It is not a myth, but the it is not entirely true either.
The Commission decided that certain "quality" of vegetables and fruits should be categorised. Thus you have grade A etc
This resulted in certain produce not being saleable, though it was perfectly good for consumption. The lady in the video refers to this as the 20% waste.
It is usable Produce but cannot be sold.

The best fruit and veg is what we grow in our gardens and the inane EU has no control over what I grow and what we eat.
