Britain's top lawyer decided today that no action would be taken against a Muslim woman accused of listening to an MP3 music player under her hijab while on jury duty.

As we reported last month the woman was thrown off the jury hearing a murder trial at a London court when one of her fellow jurors reported seeing headphone wires coming out of her headscarf. She had also been accused of being repeatedly late and doodling instead of paying attention.

The case was briefly halted while the woman, who could have been jailed if she had been found guilty of contempt under rules governing what is allowed in court, was discharged from the jury and arrested.

However, Attorney General Baroness Patricia Scotland decided not to press criminal charges, saying it would be too difficult to prove if the woman was guilty, a spokeswoman for her office said. Cynics might question whether the decision not to prosecute is in fact due to the risk of being seen to upset “community relations” and that being a Muslim is a get out of jail free card in this case.

Prosecutors said there had been contempt cases where people had taken pictures using mobile phones in court, but it was believed to be the first of its kind involving a juror suspected of listening to music.
