Angry Rapist 'should have been kicked out'

An illegal immigrant who raped a stranded young woman after he offered her a bed for the night has been jailed for four years.

Nigerian law graduate Victor Giwa-Osagie, 39, should not have been in the country when he attacked the woman who ran screaming naked from his Bradford flat in March this year.

He will be deported when he has served his sentence, but today MPs demanded to know why the immigration system had let down the victim.
Sentencing Giwa-Osagie yesterday, Judge Peter Benson told him it was a classic case of a woman saying no and meaning no. He said: "You realised that, but you forced yourself upon her. You were determined to have your way with her."

Bradford Crown Court heard that Giwa-Osagie met the woman at a Bradford city centre night club as she enjoyed a night out with friends. Prosecutor Nicholas Askins said she had become drunk. After leaving the club at 3am they shared a taxi to Leeds but the 21-year-old woman realised she had lost the keys to her flat.

Mr Askins said Giwa-Osagie suggested she stayed with him and he paid for a taxi back to his flat in Shaftesbury Avenue, Heaton, where they listened to music and she drank spirits.

The defendant tried to kiss her but she told him they were only friends. Giwa-Osagie said she could sleep in his bed. She got in, removing her jeans for comfort, but otherwise was fully clothed and wrapped herself in a quilt.
Mr Askins said: "He took hold of her arm and tried to turn her towards him. She said no,' but he removed her clothing and pinned her to the bed by her arms."

He performed a sex act as she struggled and kicked and tried to get him off. He removed his clothing and had sex with her, despite her efforts to stop him. After the rape he blocked her way as she tried to leave and she punched him in the face until he moved out of the way and she was able to flee down the street.

The victim, who suffered slight injuries in the attack, alerted police on her mobile phone and Giwa-Osagie was arrested nearby.

Mr Askins said the defendant gave police the name and date of birth of his brother. Further inquiries uncovered his true identity. Giwa-Osagie then admitted to police he had given false details because he was a Nigerian national who had overstayed in this country and he feared deportation.
Shipley Conservative MP Philip Davies said: "This case is absolutely tragic, particularly for the victim.

"If we had a sensible immigration and asylum system, this chap would have been kicked out of the country. "Unfortunately, this is a real life tragic example of the consequences of having such a shambolic system. What attracts these undesirable people is that they know there is very little chance of them being removed once they are here."

Bradford North Labour MP Terry Rooney added: "Any sexual attack on a woman is intolerable. Far too few get to court. I am glad this one did and that there has been a conviction. If he should not have been here, he should not have been here. If there's a flaw in the system it needs addressing."

Detective Inspector Noel Devine, of Bradford North CID, said Giwa-Osagie would be deported when he had served his sentence. He said: "He befriended her and acted as a Good Samaritan, offering her a bed when she could not get home. He then used the trust he had gained to take advantage of her in an horrific ordeal. "It was terrifying for her but she bravely tried to fight him off and then ran into the street, naked and clutching her clothes and screaming for help.

"She is happy with the sentence and hopes to use it as a form of closure to get on with her life."

Giwa-Osagie, who had no previous convictions, pleaded guilty to rape and perverting the course of justice by giving false details to police. His barrister, Jeremy Hill-Baker, said: "This was not a predatory and pre-planned attack. He had not deliberately plied her with drink and he believed she was showing him signs of encouragement up to the point when he went far too far."

Judge Benson said Giwa-Osagie had taken advantage of the situation and forced himself upon her when she had made it clear she did not want any sexual contact. A spokesman for the Border and Immigration Agency refused to comment on individual cases but said it had made it clear it would seek to deport foreign nationals who had committed a serious crime in the UK.
