    CAMP PENDLETON - A military judge on Friday refused to dismiss charges against a Marine who led a squad that killed 24 Iraqi men, women and children in the town of Haditha after a bomb killed a Marine.
    The ruling cleared the way for a court-martial for Staff Sergeant Frank Wuterich, the only remaining defendant in the biggest criminal case against US troops to arise from the Iraq war.
    Marine Lieutenant Col. David Jones said attorneys for Wuterich failed to show that two generals who oversaw the case were influenced by a top aide who was disqualified under military policy from giving advice because he had investigated the killings on a previous assignment.
    Wuterich, seated in uniform, showed no emotion when the judge denied the motion by his attorneys.
    He later told reporters he was disappointed and upset by the ruling but looked forward to a jury trial.
    "I'm actually happy to see that there is a trial date and this will be over soon," he said. "At least this is the beginning of the end."


    Jones said it was probably not a good idea for the aide, Col. John Ewers, to have been in the room when the Haditha case was being discussed, but there was no suggestion that his presence influenced the generals or stifled junior attorneys who were present.
    "The court must deal with the facts, not mere speculation or conjecture," Jones said.
    The judge said he was convinced the general who brought charges in December 2006 and his successor who ordered a court-martial a year later had done extensive independent research.
    "It is reassuring to know that the generals really did their homework ... and didn't merely act as a rubber stamp," Jones said.
    30-year-old Wuterich is one of eight Marines originally charged with murder or failure to investigate the killings that occurred after the roadside bombing. Six have had charges dropped or dismissed, and one was acquitted.
    A trial is scheduled for September 13 for Wuterich on reduced charges of voluntary manslaughter in nine of the 24 deaths and other crimes in the November 2005 shootings. His attorneys said they anticipated no more delays.
    Wuterich is currently assigned to administrative work at 1st Marine Division headquarters at Camp Pendleton and is working toward a certificate as a computer technician at a community college.
    "It's hard to continue to do the job that I'm doing knowing that I'm really not going anywhere as far as my career," he said.

    I can understand why he may have done what he did.

    His friend being killed off by a savage heartless peice of crap
    which I will no longer mention of since 'it' deserves no meaning
    and recognition from it's filth. I can demonize better than that,
    but I'm right now at the moment waiting for a call.


    That was wrong though to kill the women and children. How exactly
    did the squad kill them? Did they bomb them? And why exactly were
    the women and children in the way?

    He went to far when the women and children were harmed, your supposed
    to not harm civillians and your supposed to control yourself when you become
    angry of the event that occured and struck you emotionally.



    What about the marine who died, I want to know more on him.



    What will happen is the media and others to will come out and paint this
    picture that the U.S. forces in Iraq are complet heartless brute's who
    sway and swift around as some comic book character of a bad G.I Goe.

    You know what I mean...


    There's a nother story similar to this, but the case is less violent and
    has been put into injustice by the supreme court and the media.
    History is our greatest gift that must be taken into consideration.
    Without it we have no human instinct and neither strong convictions.
    We exist to this day to fullfill this duty of Honor that we do NOT
    forget it and that We preserve it's memory. It is our Key to this Future.

    You cannot put charged up young men into war zones and not expect a few incidents that go against the grain.In war the boundries we live by become a bit fuzzy at times. The polititions should remember that before they order soilders into areas with large numbers of civilians.

    Absolutely!

    What needs to happen because of this injustice that has been occuring is they need to throw these so called
    politicians into the war zone themselves then let them go through the event these soldiers go through who put
    their lives on the line to defend the very country they love and show their support for willing to die for.

    You seriously think that war zone or not, the obviously premeditated action which Frank Wuterich and his men took, which was not in the immediate heat of battle but was carried out subsequently, was excusable? Yes, can expect 'a few incidents' in areas filled with civilians, but not this. From what I've read about the case I'm amazed the original murder charges were dropped, but then what do we expect when the military are trying to protect their own.

    When the British troops invaded the US in the War of 1812 they landed south of Washington DC. During the preparation for the march on DC the British troops terrorized Americans civilians. They murdered civilians, raped American women and burned down farms and homes. They did it to teach the Americans a lesson. No officer or king or troop was ever held accountable for any of the atrocities.

    The Good Lord didn’t like it too much because after the attack on DC because He sent a hurricane to punish the British troops. The storm devastated the British attacking force, which sent them back south to regroup and they continued with their atrocities. However, the setback because of the storm allow the Americans much needed time to establish a defense of Baltimore, which led to the defeat of the British. Nobody was ever held accountable for the murder and rape of civilians. In Iraq there have been several trials. I think before you give lectures on the military protecting their own you need to look to the immoral actions of your government.
